Reinhart Case Lost. No Dredging In California Still!

Recommended Posts

If one of these CA court cases ever put dredges legally back in the water, I'd imagine it would be a short lived victory.  You can bet the other side will be appealing, or some new angle of attack craftily thought up.

The only avenue I see is a new case that challenges the State's contention that suction dredging harms the fish or the environment.  Their evidence on that is flimsy, but someone would have to spend a great deal of money conducting studies to disprove the State's evidence.

The studies have already been done, lots of them that show what is called de-minimus, which means insignificant harm.

Brandon was the one willing to put it all on the line financially for this case. Any other case based on harm would have to be initiated by someone willing to put it all on the line also.

The problem with this ruling other than the obvious is that it opens up all the other forms of mining/prospecting to scrutiny of being shut down based on some trumped up claim of environmental damage.  Wait until Izzy Martin starts pushing her toxic dust agenda.  She's been keeping that on the back burner but it will surface soon enough.
