No, a complete over reaction. The S7 restrictions only affect mining and exploration around suburban areas, not prospecting. The new restrictions are still incredibly dumb, but dont affect us.

It's a matter of interpretation. In all my years of prospecting I have never been asked for my 'Miners right'. There are only a handful of inspectors for the whole state of Victoria, so your chances of ever meeting one are negligible.

Every now and then there is a panic (the sky's falling in) about some legislation or other that will be the downfall of prospecting. Hah! Forget the paranoia and just get out there and swing a coil.

Same here, lot of years ago the Miners right was abolished in QLD, now we have Fossicking Licenses. I did enjoy and appreciate those State Forests you folks have/had? down in Victoria back in the 90s, but even there so close to towns/cities I was never asked to produce my Miners Right. Run across a few disgruntled prospectors who seemed to have plenty of time to complain of the Law, whilst that lovely heavy stuff was just laying around patiently.

Largely true Reg, but ANY 'officer' of the State of Victoria can ask you to produce your Miners Right, from Parks Rangers, Police Officers, DEWLP officers etc. In 43 years of prospecting, Ive only ever once been asked and the Ranger didnt even know he was out of his jurisdiction! I had to show him on the map...

 

'Up to interpretation' allows ambiguity for political widening of laws to make our position less tenable. Just coz the Govt wont pursue it now, doesnt mean that they wont later on (to satisfy the crazy greenie vote) to stay in power. The legislation appears to deny us access in the wording...therefore it should be altered now, before its too late.
